Which direction were you flying?

Leaving the EU, EEA or the UK. Covered, always. The regimes attach to the departure airport, so TUI Airways is on the hook for a flight out of London, Paris, Frankfurt, Madrid or anywhere else in the bloc exactly as a European airline would be.

Arriving in the EU or the UK from outside. TUI Airways is a UK carrier, so a flight into the UK from anywhere is covered by UK261. Flying home to Britain with them from outside Europe, a three-hour delay is claimable — on a non-UK, non-EU airline on the same route it is not.

What you would be paid

UK261 amounts, per passenger, by great-circle distance to your final destination.

Flight distanceCompensationReduced amount
Under 1,500 km£220—
1,500–3,500 km£350—
Over 3,500 km£520£260 if 3–4h late

Flights touching Canada

On flights to, from or within Canada, TUI Airways is subject to the APPR as a large carrier, which pays CA$400, CA$700 or CA$1,000 depending on whether you arrived 3–6, 6–9 or 9+ hours late.

Canadian claims must go to the airline within one year of the flight, which is far tighter than Europe. See the APPR page.

Flights to and from the United States

US law gives you nothing for a delay. That makes TUI Airways a materially better bet on transatlantic routes than a US carrier: flying London to the States you are covered on departure, and coming back you are covered too because TUI Airways is a UK carrier. On a US airline the return leg pays nothing. What you do have is an automatic cash refund if the flight is cancelled, and a real payment scale for being involuntarily bumped. The US rules in full.

Claiming from TUI Airways

Go direct first, through the airline's own complaints form so the claim gets a reference number. Quote the regulation, the distance band and the figure — our template letter does all three, which is what separates a real answer from a goodwill reply. If they refuse or ignore you, escalate to the national enforcement body or, for UK flights, the airline's ADR scheme. Only then consider a claim company, because they will take roughly a third of it.

Questions about TUI Airways

Can I claim compensation from TUI Airways?

Yes on any flight departing the EU, EEA or UK, whoever the airline is. And yes on flights into the UK as well, because TUI Airways is a UK carrier.

How much does TUI Airways pay for a delayed flight?

£220 to £520 per passenger depending on distance, for an arrival three or more hours late. On long-haul flights the amount is halved if you arrived between three and four hours late.

Does TUI Airways have to give me a hotel?

Where the 261 regimes apply, yes — meals during the wait, and a hotel with transport if you are kept overnight. That duty applies even when compensation does not, so a weather cancellation still has to be looked after.

What if TUI Airways says it was extraordinary circumstances?

Ask for the specific cause and the evidence; the burden is theirs, not yours. Weather and air traffic control qualify. A technical fault, a crew shortage or a strike by their own staff generally does not. Here is how to reply.
